なりすまし注文・いたずら注文に対する当社の対応について

いつもサクラ印はちみつオンラインショップをご愛顧いただき誠にありがとうございます。
当社において架空または他人の個人情報(氏名・住所・電話番号等)を無断利用した「なりすまし注文」「いたずら注文」や「自己都合による受取拒否」等、悪質な迷惑行為が発生いたしました。
当社では、これらの悪質な行為を防止するため、以下の対応を取ることにいたしました。

ご注文時の対応

1)通常想定しない高額注文や大量注文のお客様には、ご注文後に電話やメールにて確認させていただく場合がございます。
2)過去のお取引の状況によりご注文をお断りする場合がございます。
3)ご注文の際にご登録頂いた電話番号やメールアドレスにて連絡が取れず、ご本人様確認が出来ない場合、ご注文はキャンセル扱いする場合がございます。

なりすまし注文・いたずら注文等が行われた場合

なりすましやいたずらは、詐欺罪、詐欺未遂罪、業務妨害罪にあたります。
なりすまし注文・いたずら注文等の悪質・不正な注文であると当社が判断した場合、またそれらの行為により当社や第三者へ損害を与えた場合、個人情報・IPアドレスを関係機関に報告すると共に「電磁的記録不正作出・供用」(刑法161条の2)や「偽計業務妨害罪」(刑法233条)等で警察へ被害届けを提出致します。
さらに、警察を通してインターネット接続業者・電話会社等に調査を依頼し、いたずら注文を行った者を特定の上で損害賠償を請求致します。

お客様にはご不便おかけいたしますが、当社対応につきご理解いただき、ご協力賜りますよう、何卒よろしくお願い申し上げます。

Our response for prank orders and orders by impostors

Thank you for using the Sakura Honey Online Store.
We have received reports of malicious and unwanted actions, including orders by impostors using fake or other people’s personal information (such as name, address, and phone number) without permission, prank orders, and recipients refusing to accept delivered items for personal reasons.
To prevent such malicious conduct, we have decided to take following actions.

Our response when an order is placed

1) We may contact, by email or phone, customers who place unusually expensive or large orders to confirm those orders.
2) We may refuse to take orders from certain customers based on their order history.
3) We may cancel orders if we are unable to identify the customer due to being unable to contact the customer by the phone number or email address provided when the order was placed.

Orders by impostors and prank orders

Orders by impostors and making prank orders are regarded as criminal offences such as fraud, attempted fraud, or obstruction of business.
If it comes to our attention that the order was unjust and illegal, such as an order by an impostor or a prank order, and if such conduct causes damage to us or any third parties, we will notify the person’s personal information and IP address to relevant institutions and file a police report for “Unauthorized Creation of Electronic or Magnetic Records” (Penal Code, Article 161-2) and “Damage to Credibility; Obstruction of Business” (Penal Code, Article 233), etc.
We will also request the Internet provider, phone company, etc., via the police to conduct an investigation, and claim compensation for damages after identifying the person who placed the fake orders.

本公司对假冒订单、恶作剧订单的应对措施

非常感谢您一直以来对樱印蜂蜜网店的厚爱。本公司曾发生过恶意滋扰事件，如利用虚构的个人信息或擅自利用他人的个人信息（姓名/地址/电话号码等）下达“假冒订单”和“恶作剧订单”，以及“因个人原因拒收”等。
本公司为防范此类恶意行为，决定采取以下应对措施：

下单时的应对措施

1）对于下达超出一般预料范围的高额订单或大量订单的顾客，我们可能会在您下单后通过电话或电子邮件进行确认。
2）根据您过去的交易情况，我们可能会拒接您的订单。
3）如果我们无法通过您在下单时登记的电话号码或电子邮件地址与您取得联系，也无法确认您的身份，您的订单可能会被做取消处理。

下达了假冒订单、恶作剧订单等时

假冒订单和恶作剧订单构成诈骗罪、诈骗未遂罪、妨害业务罪。
如果本公司判定订单是假冒订单、恶作剧订单等恶意/非法订单，或此类行为给本公司或第三方造成了损害，我们将向相关机构报告下单人的个人信息和IP地址，同时会以“非法制作和提供电磁记录”（刑法第161条之2）以及“以欺诈手段妨害业务罪”（刑法第233条）等为理由向警方报案。
此外，我们将通过警方要求互联网服务提供商、电话公司等进行调查。在查明恶作剧订单的下单人之后，我们将要求损害赔偿。
